ABSTRAK
Saat ini begitu marak fenomena orang tua terutama ibu memutuskan untuk menjadi buruh migran di luar negeri. Tentu hal tersebut menuai dampak positif dan dampak negatif untuk keluarga terutama anak yang ditinggalkan. Diantara dampak positifnya adalah semua kebutuhan dapat tercukupi, tapi tidak untuk kasih sayang seorang ibu. Tidak mendapatkannya kasih sayang seorang ibu tersebut merupakan dampak negatif yang terlihat. Dengan tidak adanya seorang ibu dalam mendampingi tumbuh kembang anak tentu akan mempengaruhi proses tumbuh kembang anak. terlebih untuk perkembangan anak rentang usia sekolah yang sangat membutuhkan kasih sayang dan perhatian lebih untuk menyambut masa remajanya. Jenis penelitian ini adalah penelitian studi kasus, dengan pendekatan hukum dan HAM. Sifat penelitian deskriptif analitis, sedangkan analisa bahan hukum dilakukan secara kualitatif. Landasan teori yang digunakan adalah kewajiban dan tanggung jawab orang tua serta hak anak dalam Undang-undang Nomor 35 tahun 2014 tentang Perlindungan Anak dan Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Dari hasil penelitian disimpulkan bahwa agar hak dan kewajiban orang tua dapat terealisasi dengan baik maka perlu adanya kerjasama antara orang tua dan pengasuh di rumah. Berikut ini hasil temuan peneliti 1) Dari 8 keluarga yang peneliti teliti secara mendalam orang tua dan keluarga yang memenuhi tangung jawab dan kewajiban yang sesuai dengan Undang-undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia serta pemenuhan hak anak perspektif Islam terdapat 7 keluarga. Dan hanya satu keluarga yang semua tanggung jawab dialihkan kepada keluarga di rumah mulai dari pendidikan, pengasuhan hingga nafkah. Sedangkang keluarga yang dalam hal nafkah hanya ditanggung oleh ibu adalah 2 keluarga. 2) Dari 8 keluarga yang menerapkan tipe pengasuhan authoritative adalah 3 keluarga, yang menerapkan tipe pengasuhan authoritarian adalah 1 keluarga, tipe permissive adalah 3 keluarga sedangkan tipe pengasuhan rejecting-neglecting 1 keluarga. 3) Dengan pengasuhan authoritative anak cenderung mandiri, memiliki rasa tanggung jawab, ramah dan suka bergaul dengan teman atau orang lain, tetapi ada 1 anak yang kurang suka berinteraksi dengan orang lain. Kemudian untuk tipe pengasuhan authoritarian cenderung pendiam dan kurang bersosialisasi dengan teman. Selanjutnya untuk tipe pengasuhan permissive dan rejecting-neglecting membuat anak cenderung semaunya sendiri, kurang mandiri dan impulsif.
FULFILLING THE RIGHTS OF SCHOOL-AGE CHILDREN IN MIGRANT WORKER FAMILIES: A LAW AND HUMAN RIGHTS APPROACH
(Case Study of Migrant Worker Families in Banaran Village, Geger District, Madiun Regency)
ABSTRACT
Currently, the phenomenon of parents, especially mothers, decides to become migrant workers abroad. Of course this reaps positive impacts and negative impacts for families, especially children who are left behind. Among the positive effects is that all needs can be fulfilled, but not for a mother's love. Not getting a mother's love is a negative impact that can be seen. In the absence of a mother to accompany the child's development, it will certainly affect the child's growth and development process. Especially for the development of school age children who really need more love and attention to welcome their adolescence. . This type of research is a case study research, with a legal and human rights approach. The nature of this research is descriptive analytical, while the analysis of legal materials is done qualitatively. The theoretical basis used is the obligations and responsibilities of parents and children's rights in Law Number 35 of 2014 concerning Child Protection and Law Number 39 of 1999 concerning Human Rights. From the results of the study it was concluded that in order for the rights and obligations of parents to be properly realized, there is a need for cooperation between parents and carers at home. The following are the findings of the research: 1) Of the 8 families that the research examined in depth, parents and families who fulfill their responsibilities and obligations are in accordance with Law Number 35 of 2014 concerning Child Protection, Law Number 39 of 1999 concerning Human Rights and fulfillment of children's rights in an Islamic perspective. 7 families. And only one family where all responsibility is transferred to the family at home from education, care to living. Whereas there are 2 families in terms of living expenses only2) Of the 8 families that applied the authoritative parenting type, there were 3 families, 1 family who applied the authoritarian care type, 3 families with permissive care, while the rejecting-neglecting type of care was 1 family. 3) With authoritative parenting, children tend to be independent, have a sense of responsibility, are friendly and like to hang out with friends or other people, but there is one child who doesn't like to interact with other people. Then for authoritarian parenting types tend to be quiet and don't socialize with friends. Furthermore, permissive and rejecting-neglecting types of parenting make children tend to be at will, less independent and impulsive.
