Abstract

The number of applications for marriage dispensation continues to increase, even though underage marriages are very risky, many studies explain the adverse effects of early marriage. In this case, it creates a dilemma for the Pacitan Religious Court between granting or rejecting the application for marriage dispensation. Departing from these problems, the researcher will examine using the three problem formulations as follows: First, how do judges view the Fiqhiyah rule as an argument or legal consideration in handling disc cases in the Pacitan Religious Court, Second, how do judges apply the Fiqhiyah rule in handling disc cases in court? Religion of Pacitan, and Third, what are the implications of the application of Fiqhiyah principles to judge decisions in handling disc cases at the Pacitan Religious Court. In this study, researchers used qualitative research methods using data triangulation techniques. The results of the study show that the fiqhiyah principles that are often used are three rules, namely Rejecting Damage must take precedence over bringing benefit, harms allow prohibitions and special harms must be borne to avoid general harms.
